03 / INDUSTRY FOCUSNew Export Restrictions on Recoverable Critical Minerals Take Effect August 27, 2026

On July 30, 2026, the President signed a Presidential Determination under Section 101 of the Defense Production Act addressing recoverable critical minerals and materials (CMMs), and the Department of Commerce moved quickly. A Bureau of Industry and Security (BIS) allocation order published on August 6 takes effect August 27, 2026, with real consequences for the electronics recycling and ITAD industries.

The determination found that recoverable critical minerals contained in end-of-life products and industrial waste, including black mass, end-of-life rare-earth permanent magnets, swarf, and other waste and scrap containing critical minerals, are critical industrial resources essential to national defense. It delegated authority to the Secretary of Commerce to restrict their export.

What the new order requires:

• U.S. persons selling black mass (shredded lithium-ion battery scrap) and tungsten waste and scrap must allocate 100% of monthly sales to U.S. persons, effectively prohibiting export without prior BIS authorization
• Sellers must report buyer information, the applicable Schedule B code, and the quantity and value of each sale
• Exception requests go to BIS at DPASAllocations@bis.doc.gov, which intends to respond within 14 days
• Public comments are due November 4, 2026, and the order is currently set to expire August 27, 2027

Most enterprise organizations will not be directly subject to the allocation order. It lands on the companies selling these materials. But it reshapes the downstream channels your ITAD vendor depends on, and it signals where policy is heading for the rest of the recoverable critical minerals stream.

For enterprise organizations, this development reinforces several important considerations:

• Retired IT assets are gaining strategic and economic value as domestic sources of critical minerals
• Where and how your retired equipment is processed matters more than ever, as export-dependent disposition channels now face real restrictions
• Vendor due diligence is becoming increasingly important, as organizations will want assurance that their ITAD partners process materials domestically and in compliance with evolving trade regulations
• Documentation and downstream transparency will be key to demonstrating compliant disposition as these rules take effect
